Privacy Policy

This Privacy Policy should be read in conjunction with the Terms of Service, which is incorporated by reference and may be.

1. Privacy policy

This Privacy Policy outlines how HELPSEEKER INC. (referred to herein as “HelpSeeker” or “we” or “us” or “our”) collects, uses, and discloses your Personal Information (defined below) through our website, web applications, mobile application, social media channels, and other online offerings that link directly to this Privacy Policy (collectively, the “Applications”). This includes information collected through our specific products—Navigi, Karto, and Mareto—each of which is designed to support our users in unique ways:

Navigi enhances navigation and location-based services, focusing on geographical data integration.

Karto offers advanced analytical tools for mapping and statistical analysis.

Mareto facilitates case management with comprehensive data-handling functionalities.

Additionally, our website and social media platforms are integral parts of our service offerings, used for engaging with users, providing support, and sharing information about our products and services. We also process information from these channels to better understand user preferences and improve user experience across all our platforms.

This policy applies to all Personal Information collected via the Applications, whether you are using our specialized products or interacting with us online through our website and social media channels.

Any information you store on the Applications is yours and we claim no rights to it, except as expressly set out in this Privacy Policy. You do not have to provide us with any Personal Information to visit the public portions of the Applications. However, if you choose to withhold requested information, you may not be able to visit all sections or use all features of the Applications or access all of the Services offered by HelpSeeker.

Please note that by using our Services, you are acknowledging and agreeing to the practices described in this Privacy Policy. If you do not agree with this Privacy Policy, please do not use the Services. If you do agree to these terms you may withdraw your consent at any time by contacting HelpSeeker at admin@helpseeker.org.

Please read this Privacy Policy carefully to understand our practices and how we will handle your information.

2. Scope

This Privacy Policy applies in relation to the provision of the Services and in particular to your use of, or engagement with either or both of the following: 

  1. the Applications; and
  2. any other communications or interactions (whether over telephone, email, SMS message or otherwise) between you and us in connection with the provision of the Services.

This Privacy Policy sets out the basis on which any information we collect from you or that you provide to us in connection with your use of the Services is collected, used or disclosed by us. 

IMPORTANT: If you are a client of an organization that uses HelpSeeker’s products in providing its services to you, please contact that organization for information regarding how your information is collected, used and disclosed. This Privacy Policy does not apply to you unless you use the Applications or Services or otherwise interact with HelpSeeker. 

3. Information we collect and use

We will collect and use your information only with your consent, which may be express or implied in certain circumstances, or as otherwise permitted or required under applicable law.

HelpSeeker strongly supports online privacy and individual rights. We respect your privacy and only collect the minimum data necessary to provide the Services effectively. 

“Personal information” refers to any information that can be used to, directly or indirectly, identify an individual. Information about a business or that is limited to business contact information collected and used to communicate for business purposes is generally not subject to this policy.

We may collect and use some or all of the following Personal Information about you (as applicable): first and last name, address, email, and payment information. We will also collect certain information automatically when you use the Applications (see cookies section below).

Additionally, when you register for or request Services, make payments, request feedback, download software, or enter contests from the HelpSeeker Applications, HelpSeeker may ask you to provide contact and preference information by submitting an online form. 

We will collect, use, disclose, and otherwise process your Personal Information for the following purposes:

  1. To create and maintain your account.
  2. To process or facilitate payments for the Services.
  3. To improve the features and functionality of the Applications.
  4. To inform you of upgrades and changes to the Services, special offers, and other products and services that you may be interested in,
  5. To comply with applicable federal or provincial laws.
  6. To comply with requests from regulators, government entities and official inquiries. 
  7. To monitor metrics such as total number of visitors, traffic, and demographic patterns.
  8. To prevent against the corruption and/or loss of your Personal Information, to ensure the security of our systems and to carry out our regular testing to ensure the smooth maintenance of our systems.
  9. For any other reasonable purposes communicated to you or as required by law.

4. Sharing your information

We may disclose some or all of the information we collect from you in connection with your use of the Services to the following third parties:

  • any company within our HelpSeeker group, which means our subsidiaries, parent company, and affiliated companies  for the provision of the Services;
  • our service providers and agents (including their sub-contractors) or third parties which process information on our behalf (e.g. internet service and platform providers, payment processing providers and those organizations we engage to help us send communications to you) so that they may help us to provide you with the Applications and Services and any other, products, services and information you have requested or which we believe is of interest to you;
  • third parties used to facilitate payment transactions, for example, clearing houses, clearing systems, financial institutions and transaction beneficiaries;
  • third parties where you have a relationship with that third party and you have consented to us sending information (for example social media sites or other third-party application providers);
  • third parties for marketing purposes, in which case the information shared is not Personal Information;
  • regulators to meet HelpSeeker’s legal and regulatory obligations;
  • law enforcement agencies so that they may detect or prevent crime or prosecute offenders;
  • any third party in the context of actual or threatened legal proceedings, provided we can do so lawfully (for example in response to a court order);
  • any third party in order to meet our legal and regulatory obligations, including statutory or regulatory reporting or the detection or prevention of unlawful acts;
  • our professional advisors and auditors for the purpose of seeking professional advice or to meet our audit responsibilities;
  • another organization if we sell (or negotiate to sell) substantially all our assets to such organizationy, as information held by us about our customers will be one of the transferred assets;
  • another organization to whom we may transfer our agreement with you; and
  • government departments where reporting is mandatory under applicable law.

5. Cookies and automatically collected information

We may receive and store certain information about you and your device(s) automatically when you access or use our Applications. This information may include: the domain used to access the Applications, IP address (the Internet address of your computer) unique device identifiers, the type and version of browser or operating system being used by visitors to the Application, your device type, and aggregated information, such as demographic and interest statistics of our users (e.g. average age, geographical allocation, or affinity categories of our users), number of visitors, what pages users access or visit, and average time spent on the Applications.

Our web servers may automatically collect information that is provided through your browser or stored in a cookie when you choose to visit the Applications. Cookies are small data files transferred to your computer’s hard-drive by a website or other Internet-connected devices. They keep a record of your preferences making your subsequent visits to the website more efficient. Cookies may store a variety of information, including, the number of times that you access a website, registration information and the number of times that you view a particular page or other item on the Applications. We use cookies to provide you with a tailored experience when visiting our Applications and using our products and services.  

Most browsers are designed to accept cookies, but they can be easily modified to block cookies; see your browser’s help files for details on how to block cookies, how to know when you have received cookies and how to disable cookies completely. You should know, however, that without cookies, some of our Applications’ functions will not be available and you as user will lose some of the benefits of the Applications.

We use remarketing services to advertise on third-party websites to you after you visit the Applications. We, and our third-party vendors, use cookies to inform, optimize and serve ads based on your past visits to our Applications. In certain circumstances, your implied consent to our accessing, using or disclosing may be provided if you do not instruct your web browser to refuse all cookies or to indicate when a cookie is sent or if you do not opt out of Google Analytics or other services, as indicated below.

6. Aggregate Data, user behavior and analytics tracking

HelpSeeker may use its own proprietary analytics metrics tool and third-party analytics technologies, such as Google Analytics, to collect information when you use the Applications, such as unique device identifiers and settings, internet provider, carrier, operating system, hardware information, localization information, date and time spent on the Applications, your search activity, metrics and statistics, feature usage and time spent on the Applications, advertising conversion rates, monetization rate, purchase history, and other similar information.

HelpSeeker may share or solicit Aggregate Data about users to third parties. For example, HelpSeeker may disclose the number of users that have been exposed to, or clicked on, a particular client listed on the Applications. HelpSeeker uses this information to improve the Services and to share information about user behavior in relation to the Services to, without limitation, businesses, social service agencies, and educational institutions.

You agree that HelpSeeker will have the right to generate Aggregate Data and that the Aggregate Data may be used for a business purpose during or after your use of the Applications or Services (including without limitation to develop and improve HelpSeeker’s Services and to create and distribute reports and other materials). For clarity, HelpSeeker will only disclose Aggregate Data externally in an anonymous form that does not personally identify the user and will be stripped of all persistent identifiers (such as device identifiers, IP addresses, and cookie IDs). You are not responsible for HelpSeeker’s use of the Aggregate Data.

7. How we protect and retain your Personal Information

The security of your Personal Information is important to us. We protect your Personal Information by maintaining physical, organizational and technological safeguards appropriate to the sensitivity of such Personal Information. HelpSeeker takes the security of Personal Information very seriously. HelpSeeker employs firewalls, anti-malware, strong encryption, intrusion detection and prevention systems. Personal Information may only be accessed by persons within our organization who require such access to provide you with the Services indicated above.

We retain Personal Information that we collect only as long as necessary for the purposes for which it was collected or to meet legal requirements. We destroy Personal Information when it is no longer needed.

8. Children

Our Services are not intended for children under the age of majority in their jurisdiction of residence (“Children”). No Children may provide any information on the Applications or use the Services. We do not knowingly collect Personal Information from Children. If you are a parent or guardian and know that your Child has provided us with Personal Information, please contact our Privacy Officer (see contact information below). If we become aware that we have collected Personal Information from Children without verification of parental consent, we take steps to remove that information from our servers.

9. Links to third-party websites

The Applications may contain links to and from the websites of our partner networks, advertisers, and service providers. If you follow a link to any of these websites, please note that these websites and any services that may be accessible through them may have their own privacy policies and that we do not accept any responsibility or liability for these notices or for any Personal Information that may be collected through these websites or services, such as contact and location data. Please check these notices before you submit any Personal Information to these websites or use any such third-party services.

10. Storing and transferring of your Personal Information

HelpSeeker is based in Alberta, Canada. We use service providers who may, however, access and handle your Personal Information on our behalf outside of Alberta and Canada. We have agreements in place with those service providers to ensure your information is protected in accordance with this Privacy Statement when it resides outside of Canada; however, the transferred information will be subject to the laws of the applicable jurisdiction and may be accessible by courts, law enforcement, and national security authorities of that foreign jurisdiction. 

Mareto, our Case Management software, processes Personal Information necessary for its functionalities. To ensure the security of this information, it is stored on cloud-based servers located within Canada, in compliance with Canadian privacy laws. We prioritize robust security measures to safeguard the Personal Information handled by Mareto. 

If you have any questions about the collection, use, or disclosure of Personal Information by a service provider outside Canada, please contact our Privacy Officer at (see contact information below).

11. Access and rectification

You may send us an email at admin@helpseeker.org to request access to, correct, or delete any Personal Information that you have provided to us. We may not accommodate a request to change information if we believe the change would violate any law or legal requirement or cause the information to be incorrect. We may also need to retain certain information for billing or other purposes identified at the time of collection of the information, or as otherwise required by law.

We may request specific information from you to help us confirm your identity and your right to access, and to provide you with the Personal Information that we hold about you or make your requested changes. Applicable law may allow or require us to refuse to provide you with access to some or all of the Personal Information that we hold about you, or we may have destroyed or made your Personal Information anonymous in accordance with our record retention obligations and practices. 

12. Changes to this privacy policy

The Services and our business may change from time to time. As a result, at times it may be necessary for us to make changes to this Privacy Policy. HelpSeeker reserves the right, in its sole discretion, to update or modify this Privacy Policy at any time (collectively, the “Modifications”). Modifications to this Privacy Policy will be posted to the Application with a change to the “Updated” date at the top of this Privacy Policy. In certain circumstances, HelpSeeker may, provide you with additional notice of such Modifications, such as via email or with in-Application notifications. Modifications will be effective fifteen (15) days following the “Updated” date or such other date as communicated in any other notice to you.

Please review the Privacy Policy periodically, and especially before you provide Personal Information to us. This Privacy Policy was updated on the date indicated above. Your continued use of the Services following the effectiveness of any Modifications to this Privacy Policy constitutes acceptance of those Modifications. If any Modification to this Privacy Policy is not acceptable to you, you should cease accessing, browsing and otherwise using the Applications and the Services.
